By using this site or engaging Brillion Studio for services, you agree to these terms. If you do not agree, please do not use the site or the services. We may update these terms, material changes will be flagged at the top of this page with a new "last updated" date.
Our services include brand strategy, website design and development, and marketing systems. The exact scope, deliverables, timeline, and fees are defined in a separate Statement of Work (SOW) signed at the start of each engagement. These site terms do not replace that SOW; the SOW governs the engagement.
You agree to use the site and our products lawfully. You may not: use them for any unlawful purpose; send spam or unsolicited bulk messages; harass, abuse, or threaten anyone; scrape or harvest data from the site or product; attempt to breach or circumvent security; or misuse any social or advertising account connected to the product. Because the product can send outbound messages (Instagram direct messages, SMS, and email) on your behalf, you must ensure any such outreach is lawful and permission-based.
Our product lets you connect third-party platforms — for example Instagram and Facebook (via Meta) and Google (Analytics, Ads, and Business Profile). When you connect a platform you also agree to that platform's own terms, and you authorize us to access that account only as you direct, solely to provide the reporting and messaging features to you. You or the platform may revoke that access at any time, and platform data may be governed or limited by the platform's own policies.
You are responsible for having the right to connect the accounts you connect to the product, and for the lawfulness of any outbound messaging (Instagram DMs, SMS, or email) sent through it — including obtaining any consent required from recipients. You will not use the product to send messages that violate applicable law or a connected platform's policies.
Invoices are due net 14 unless otherwise specified in your SOW. Late payments accrue interest at 1.5% per month or the maximum allowed by law, whichever is lower. We reserve the right to pause work on overdue accounts and to withhold final deliverables until payment is received.
Fees for work already delivered are non-refundable except where these terms expressly state otherwise.
A sprint is one scoped job, run end to end, at a fixed fee starting at $1,500. A sprint is typically a build, a month of social, a month of media buying, a branding engagement, or a local event we run and document for you. The scope, the fee, and the finish date are agreed in writing before you pay, and that written scope governs the sprint. Anything outside it is quoted separately and does not begin until you approve it in writing.
The clock starts when we have what we need, not at payment. A sprint requires a completed intake and any access, assets, approvals, or accounts named in the written scope. The finish date runs from the day we receive the last required input. If we are still waiting on you 30 days after payment, we may either deliver what the scope allows without the missing inputs, or close the file and refund the fee less the work already performed.
If we miss the agreed finish date for a reason within our control, we keep working at no additional fee until the agreed scope is delivered. Delays caused by missing inputs, changed requirements, or a third-party platform move the finish date by the length of the delay. The number of revision rounds included is stated in the written scope.
A sprint is not a retainer and does not become one. It ends on delivery, renews nothing, and bills nothing further. The fee is payable before work begins unless the written scope says otherwise, and is non-refundable once the agreed scope has been delivered. If you end a sprint after work has started, fees for work completed up to that date remain due.
Signals goes live on day one, and one viewer seat stays yours after the sprint ends, at no charge and with no time limit, whether or not you continue with us. A viewer seat is read access to your own account. Additional seats are charged per user per month at the rate quoted to you before they are added, and no seat is ever added to your account without your instruction. Signals reports on the accounts you connect, so it remains subject to Acceptable Use and Third-Party Platforms, and access ends if the engagement is terminated under Termination or if you disconnect or a platform revokes the underlying account.
Start a retainer within 30 days of delivery and the sprint fee applies as a credit against your first invoice, for whichever tier you choose, up to the value of that invoice. The credit is single-use, applies to one first month, is not transferable, and is not redeemable for cash. One credit per sprint purchased.
On final payment, deliverables produced specifically for you under an SOW are yours. We retain the right to display the work in our portfolio and case studies (with confidential details obscured if requested). Pre-existing tools, templates, and frameworks remain ours and are licensed to you for use within the deliverables.
Either party may end the engagement in writing. On termination, any connected-platform access ends immediately, and we will delete or return your data on request (see our Privacy Policy for retention timelines). Fees for work completed up to the termination date remain due under your SOW.
Our total liability for any claim arising from your use of the site or our services is limited to the fees you have paid us in the prior six months. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by the laws of the State of Texas, USA. Any dispute will be resolved in the state or federal courts located in Harris County, Texas.
